About these terms
These terms describe use of the BeekeeperOS marketing website and Early Access activities. Product access may also require separate beta or application terms presented before use. These terms do not replace an existing signed agreement. Questions: hello@beekeeperos.com.
Eligibility and Early Access
The site and service are not directed to children under 13. Do not submit personal information about a child under 13. You must have legal authority to enter an agreement and to provide any information on behalf of an organization. Early Access signup expresses interest; it does not create an application account or guarantee an invitation, release date or particular feature. Beta features and access may change, be limited or be discontinued.
Your responsibilities
Provide accurate information, use the service lawfully and protect any credentials provided to you. You are responsible for your beekeeping activities, decisions and records. Maintain appropriate independent backups of important information. Promptly tell us about suspected unauthorized access.
Beekeeping judgment and product guidance
BeekeeperOS organizes information and supports your understanding. It does not replace hands-on training, local expertise, mentors, professional advice or beekeeper judgment. Follow current product labels and applicable laws and regulations. We do not guarantee colony health, survival, honey yield, treatment effectiveness or regulatory compliance. You remain responsible for evaluating information and deciding what is appropriate for your colonies.
Your content and records
You retain ownership of the content and hive records you enter. You grant BeekeeperOS a nonexclusive permission to host, store, process, display, analyze and use that content as reasonably necessary to provide, maintain, secure, operate and improve the service. This permission is subject to our privacy commitments and does not transfer ownership. You must have the rights needed to submit the content. We may use appropriately aggregated or de-identified information for analysis and improvement, with reasonable measures to prevent identification.
Our intellectual property
BeekeeperOS branding, software, designs and original site materials belong to BeekeeperOS or its licensors. Subject to applicable terms, you may use the site for its intended purposes. No ownership rights are transferred to you. Do not misuse our trademarks or copy, redistribute or exploit protected materials without permission, except as allowed by law.
Prohibited use
Do not compromise security, access information without authorization, introduce malware, interfere with operation, impersonate others, submit unlawful or infringing content, send spam, or use the service to violate another person’s rights. Do not attempt to evade reasonable usage or access restrictions.
Availability and changes
We may change features, correct errors, maintain the service or discontinue Early Access or beta activities. Access may be suspended or terminated for abuse, security concerns, legal requirements or other legitimate operational reasons. Where practical, we will give reasonable notice of material changes or termination. Availability and access to records are not guaranteed.
Disclaimers
To the fullest extent permitted by applicable law, the site and service are provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose and noninfringement. We do not promise uninterrupted, error-free or secure operation, or protection against data loss. Nothing excludes rights or warranties that cannot lawfully be excluded.
Limits of liability
To the fullest extent permitted by law, BeekeeperOS and its providers are not liable for indirect, incidental, special, consequential or punitive losses, including lost profits, lost records or business interruption arising from use of the site or service. Our total liability arising from the free marketing site or Early Access activities will not exceed $100. Separate paid-service terms may specify different limits. These limits do not apply to liability that cannot legally be limited and do not reduce mandatory consumer rights.
Reasonable indemnification
To the extent permitted by law, you agree to cover reasonable losses and costs arising from a third-party claim caused by your unlawful content, infringement of another person’s rights, or intentional misuse of the service. This does not require you to cover claims caused by our own unlawful conduct. We will provide reasonable notice of a claim and cooperate in its defense; no settlement may impose obligations on you without your consent.
Disputes and applicable law
Please contact hello@beekeeperos.com first so we can try to resolve a concern informally. These terms are governed by Indiana law, excluding conflict-of-law rules, subject to any mandatory protections that apply where you live. Nothing in these terms requires binding arbitration or waives rights that cannot lawfully be waived.
Changes and contact
We may revise these terms and update the date above. Material changes will be communicated when appropriate or required. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law. Contact hello@beekeeperos.com with questions.
